Mandatory Aviation Safety Warning

The Services and Data are non-certified, informational resources. They may be incomplete, delayed, inaccurate, unavailable or incorrect.

They are intended only to support situational awareness and the see-and-avoid principle. They are not approved for air traffic control, separation, navigation, collision avoidance, operational dispatch, or any other safety-critical purpose.

Never rely on the Services or Data in place of visual lookout, official aeronautical information, approved equipment, applicable procedures, or instructions from air traffic control or other competent authorities. Do not use them as a basis for flight in instrument meteorological conditions.

You remain solely responsible for the safe and lawful conduct of every operation and for deciding whether to commence, continue, modify or terminate it.

This Agreement is a single global framework for SafeSky Sentinel, SafeSky Live and related SafeSky services. Mandatory consumer rights and non-excludable legal obligations always prevail.

Part I. General Terms of Use

These Terms govern access to and use of the services, applications, websites, data, content, communications, features, subscriptions and related offerings made available by SafeSky SRL (collectively, the “Services”). The Services currently include SafeSky Sentinel and SafeSky Live and may include renamed, updated, successor or additional SafeSky offerings.

1. Scope, acceptance and eligibility

These Terms form a binding agreement between SafeSky SRL (“SafeSky”, “we”, “us”) and the person or organisation accessing or using the Services (“you”). By creating an account, selecting an acceptance control, purchasing a subscription, or otherwise using the Services, you agree to these Terms. If you use the Services on behalf of an organisation, you represent that you have authority to bind it.

You must be legally capable of entering into this agreement. Where local law requires consent from a parent or guardian, you may use the Services only with that consent. You may not use the Services where prohibited by law, sanctions, export controls or applicable aviation rules.

Additional product, enterprise, order-form or integration terms may apply. If they conflict with these Terms, the more specific signed or expressly accepted terms prevail for the relevant subject matter.

Order of precedence. If provisions conflict: (a) mandatory applicable law prevails; (b) a signed enterprise agreement, data processing agreement or order form prevails for the specific subject it governs; (c) applicable regional privacy provisions prevail over the general Privacy Policy; (d) the Privacy Policy prevails for the processing of Personal Data; and (e) these general Terms apply in all other respects.

2. Definitions

3. Licence and permitted use

Subject to these Terms, SafeSky grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable right to access and use the Services for their intended purpose. The Services are licensed or made available, not sold.

Consumer-facing features may be used for personal purposes. Professional, commercial, redistribution, integration or public-display use is permitted only where expressly enabled by the applicable plan, written agreement or SafeSky authorisation.

4. Operational restrictions and user responsibilities

5. Accounts, subscriptions and payments

Some Services require an account, sign-in through an identity provider, or a paid subscription. You must provide accurate information, keep credentials secure, and promptly notify SafeSky of suspected unauthorised access. You are responsible for activity conducted through your account unless prohibited by law.

Identity providers. When you sign in through Apple, Google or another identity provider, SafeSky may receive an account identifier, email address, authentication token and limited profile information made available by that provider. Your password and other primary credentials remain with the identity provider except where technically necessary and expressly disclosed.

Organisational accounts. If your account is created, provided or administered by an employer, operator, club, authority or other organisation, that organisation may control access, settings and certain account information under its own policies. For processing carried out by that organisation for its own purposes, the organisation acts independently from SafeSky. Questions about such processing should be addressed to the relevant organisation.

Prices, billing periods, renewal rules, taxes, cancellation rights and refund terms are shown before purchase or governed by the relevant app store, order form or mandatory consumer law. SafeSky may verify entitlement and restrict paid features when a valid entitlement cannot be confirmed.

6. User content, visibility and communications

You retain rights in content and information you submit. You grant SafeSky a worldwide, non-exclusive, royalty-free licence to host, process, reproduce, transmit, display and adapt that content only as reasonably necessary to operate, secure, support and improve the Services, comply with law, and implement your selected visibility settings.

Where visibility or community features are available, the Application will describe available choices. Public visibility may expose selected profile or operational information to other users. Private or restricted modes reduce identifying visibility but do not make operational transmissions invisible where position data must be exchanged for the feature to function.

SafeSky may remove or restrict unlawful, unsafe, misleading or infringing content and may preserve or disclose content when reasonably necessary to comply with law, protect rights or safety, investigate abuse, or respond to an emergency.

Service communications. SafeSky may send communications necessary for account administration, security, safety, outages, changes to functionality, legal updates and support. These are transactional or service communications and may continue even if you opt out of marketing. Marketing communications are sent only where permitted by law and may be unsubscribed from at any time.

7. Intellectual property and data-use restrictions

SafeSky and its licensors retain all rights in the Services, Data compilations, databases, interfaces, designs, brands, documentation, algorithms and related intellectual property. Except where expressly permitted, you may not:

8. Third-party services and connectivity

The Services may depend on or interoperate with third-party platforms, maps, devices, networks, identity providers, app stores, data sources or links. Those third parties are independent and may apply their own terms and privacy notices. SafeSky does not control and is not responsible for third-party services, changes, outages, content or acts, except to the extent required by law.

9. Service availability, support and changes

SafeSky may update, modify, add, suspend or discontinue features, Data sources or Services. We use commercially reasonable efforts to preserve continuity and, where practical, to give advance notice of material planned changes. Immediate changes may be made for security, safety, legal, technical or third-party reasons.

Unless a signed order form states a specific service level, the Services are provided on a best-efforts basis under Part III and no guaranteed uptime, response time, resolution time, latency, coverage or data quality commitment applies.

10. No warranty and limitation of liability

10.1 NO WARRANTY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE”. SAFESKY MAKES NO EXPRESS, IMPLIED OR STATUTORY WARRANTY, INCLUDING AS TO ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, AVAILABILITY, SECURITY, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SAFESKY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SUITABLE FOR ANY OPERATIONAL OR SAFETY-CRITICAL PURPOSE.

10.2 ASSUMPTION OF RESPONSIBILITY
YOU ARE SOLELY RESPONSIBLE FOR YOUR USE OF AND RELIANCE ON THE SERVICES AND DATA, FOR COMPLYING WITH APPLICABLE LAW, AND FOR ALL OPERATIONAL AND SAFETY DECISIONS. THE SERVICES DO NOT SHIFT OR REDUCE THE RESPONSIBILITIES OF A PILOT, OPERATOR, REMOTE PILOT, ORGANISATION OR OTHER USER.

10.3 LIMITATION
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFESKY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS AND DATA PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL LOSS, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, OPPORTUNITY, DATA OR USE, ARISING FROM OR RELATED TO THE SERVICES, DATA OR THESE TERMS, EVEN IF ADVISED THAT SUCH LOSS WAS POSSIBLE.

WHERE LIABILITY CANNOT BE EXCLUDED, SAFESKY’S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING IN A TWELVE-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SAFESKY FOR THE AFFECTED SERVICE DURING THAT PERIOD OR (B) EUR 100. THIS CAP DOES NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

10.4 Non-excludable rights
Nothing in these terms excludes or limits liability for fraud, wilful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where it cannot be limited, or any mandatory consumer or other right that cannot lawfully be excluded.

11. Indemnification

If you are a Business User, you will indemnify, defend and hold harmless SafeSky and its affiliates, personnel, licensors and data providers against third-party claims, liabilities, losses, damages, penalties and reasonable legal costs arising from: (a) your unlawful or unauthorised use of the Services or Data; (b) your breach of these Terms; (c) your integration, redistribution, presentation or modification of Data; or (d) a claim that content supplied by you infringes another person’s rights. This obligation applies only to the extent permitted by law and does not cover loss caused by SafeSky’s own breach, negligence or wilful misconduct.

The indemnity in this section does not apply to a Consumer except where and to the extent a substantially equivalent obligation is lawful under mandatory local law.

12. Suspension and termination

You may stop using the Services at any time and may cancel subscriptions through the applicable purchase channel. SafeSky may suspend or terminate access where reasonably necessary for breach, non-payment, misuse, security, legal compliance, risk to persons or systems, discontinuation of a Service, or circumstances beyond our control. Where appropriate and lawful, we will provide notice and an opportunity to remedy a breach.

On termination, your licence ends. Provisions that by their nature should survive will survive, including intellectual property, disclaimers, liability limits, indemnities, privacy obligations, payment obligations and dispute provisions.

13. Governing law, disputes and general terms

These Terms are governed by Belgian law, without regard to conflict-of-law rules. The courts of Brussels, Belgium have exclusive jurisdiction, except that Consumers may retain the benefit of mandatory protections and jurisdiction rights available under the law of their habitual residence.

Before starting formal proceedings, the parties should attempt in good faith to resolve the dispute. Nothing prevents either party from seeking urgent injunctive or protective relief.

If a provision is unenforceable, it will be limited or replaced to the minimum extent necessary and the remaining provisions remain effective. Failure to enforce a right is not a waiver. You may not assign these Terms without SafeSky’s consent; SafeSky may assign them as part of a restructuring, merger, acquisition or transfer of the relevant business, subject to applicable law. These Terms and any applicable product-specific terms constitute the entire agreement regarding the Services.

Part II. Global Privacy Policy

This Privacy Policy explains how SafeSky processes Personal Data in connection with the Services. Regional provisions supplement this Policy and prevail where required by local law.

14. Who is responsible for your data

SafeSky SRL, company number 0761.852.549, Parc de l’Alliance, Boulevard de France 9A, 1420 Braine-l’Alleud, Belgium, is generally the controller or equivalent responsible organisation for Personal Data processed through consumer-facing Services. Contact: privacy@safesky.app.

For enterprise or integrated deployments, SafeSky and the relevant customer may each act as independent controllers, or SafeSky may act as processor/service provider. The applicable order form or data processing agreement determines those roles where required.

Where consent is legally required, it is requested separately from acceptance of these Terms and may be withdrawn at any time without affecting earlier lawful processing. Exact legal bases may vary by jurisdiction and feature.

17. Location, flight and visibility data

Location and operational data are central to many SafeSky features. When an applicable feature is active, Data may be transmitted in real time or near real time and made visible to other users, connected services, authorised customers or safety partners according to the feature and your settings. Turning off a permission or feature may prevent that feature from functioning.

SafeSky may generate identifiers or correlate information from several sources to improve traffic awareness. Such correlation is probabilistic and may be wrong. Visibility controls affect presentation of identity-related information; they do not guarantee anonymity, particularly where public registrations, radio identifiers or other external sources permit identification.

SafeSky may use aggregated or genuinely de-identified information for statistics, research, safety, interoperability, service improvement and commercial analysis. Where information is no longer Personal Data under applicable law, it may be retained and used without the restrictions applicable to Personal Data. SafeSky will not attempt to re-identify de-identified information except to test or improve de-identification safeguards or where legally permitted.

18. Sharing and disclosures

We may share Personal Data only as reasonably necessary with:

SafeSky does not sell Personal Data for money and does not share Personal Data for cross-context behavioural advertising or targeted advertising as those terms are defined by applicable US state privacy laws, unless we provide a specific notice and legally required choice.

Cookies and similar technologies. SafeSky websites and Services may use cookies, local storage, software development kits, device identifiers and similar technologies for authentication, security, preferences, diagnostics and, where permitted, analytics. Strictly necessary technologies may be used without optional consent where allowed by law. Non-essential technologies are used only with the disclosures and choices required by applicable law.

19. International transfers

SafeSky is based in Belgium and the Services operate internationally. Personal Data may therefore be processed in countries that may not provide the same level of protection as your home jurisdiction. Where required, SafeSky uses recognised safeguards such as adequacy decisions, the European Commission Standard Contractual Clauses, the UK International Data Transfer Agreement or Addendum, contractual protections, consent, or other lawful transfer mechanisms.

20. Retention, security and breach handling

SafeSky retains Personal Data only for as long as reasonably necessary for the purposes described, including to provide the Services, maintain safety and security, resolve disputes, enforce agreements, comply with law and establish legal claims. Retention periods vary by category, feature, account status, contractual commitment and legal requirement. Backup copies may persist for a limited period before routine deletion or overwrite.

SafeSky applies technical and organisational safeguards appropriate to the nature and risk of the Data, including access controls, transport encryption, monitoring, backup and incident procedures. No system is completely secure, and absolute security cannot be guaranteed. Where required by law, SafeSky will notify affected persons and authorities of a qualifying Personal Data breach.

21. Your privacy choices and rights

Depending on your location, you may have rights to access, correct, delete, port, restrict or object to processing; withdraw consent; opt out of certain sharing or targeted advertising; and appeal a refusal. You may also lodge a complaint with a competent privacy authority. SafeSky may take reasonable steps to verify your identity before responding. Where permitted by law, an authorised representative may submit a request subject to proof of authority and any necessary identity verification. SafeSky will respond within the period required by applicable law and, where a request is refused or limited, will explain the reason and any available appeal or complaint mechanism.

Privacy and permission controls are available through the relevant Application and device settings. Requests may be sent to privacy@safesky.app. Marketing communications can be stopped through the unsubscribe method provided, without affecting essential service communications.

22. Account deletion

Where an account can be created, you may request deletion through the account settings in the relevant Application and through the web-based deletion route identified in the applicable app-store listing or SafeSky website. Deleting an account deletes or de-identifies associated Personal Data, subject to limited retention required for law, security, fraud prevention, dispute resolution, financial records, safety investigations or backup cycles. SafeSky will explain material retention that applies to a deletion request.

23. Children

The Services are not directed to children under 13. Where a higher minimum age or parental-consent threshold applies in a jurisdiction, that threshold applies. SafeSky does not knowingly collect Personal Data from a child in violation of applicable law. A parent or guardian who believes a child has provided Personal Data unlawfully should contact privacy@safesky.app.

24. Regional privacy notices

European Union / EEA: The GDPR applies where relevant. Legal bases include contract, consent, legal obligation, vital interests and legitimate interests. Data subjects have the rights provided by Articles 15-22 GDPR and may complain to their local supervisory authority. International transfers use an adequacy decision or appropriate safeguards, including Standard Contractual Clauses.

United Kingdom: The UK GDPR and Data Protection Act 2018 apply where relevant. Transfers may rely on UK adequacy regulations, the UK IDTA or UK Addendum. Complaints may be made to the Information Commissioner’s Office.

United States: Residents of certain states may have rights to know, access, correct, delete and obtain a portable copy, and to opt out of sale, sharing or targeted advertising. SafeSky will not discriminate against a person for exercising applicable rights. Authorised agents and appeal processes are supported where required. SafeSky will not discriminate against you for exercising applicable privacy rights.

Canada: PIPEDA and applicable provincial laws, including Quebec Law 25, may apply. Personal information may be processed outside Canada and be subject to foreign law. Complaints may be directed to SafeSky and then to the competent federal or provincial privacy authority.

Brazil: The LGPD may apply. Data subjects may exercise the rights available under the LGPD and contact the Brazilian National Data Protection Authority where applicable.

Australia: The Privacy Act 1988 and Australian Privacy Principles may apply. Complaints may be made to SafeSky and, where eligible, to the Office of the Australian Information Commissioner.

Mainland China: The Services are not directed to, actively marketed in, or specifically offered to individuals in mainland China. SafeSky has no business presence or servers in mainland China. A person who independently accesses the Services from mainland China understands that Personal Data may be processed outside mainland China and that SafeSky does not represent that the Services are configured to satisfy mainland China localisation, filing, representative or PIPL-specific consent requirements. Where mainland China law nevertheless applies mandatorily, this paragraph does not exclude obligations that cannot lawfully be excluded.

Other jurisdictions: Local mandatory privacy rights and protections apply. SafeSky will interpret this Policy to preserve such rights to the extent required by law.

25. Changes and contact

SafeSky may update this Policy to reflect changes in the Services, law or practices. The “Last Updated” date will be revised, and material changes will be communicated through an Application, website, email or other appropriate channel. Where required, renewed consent will be requested.

Part III. Service Conditions / SLA

This Part describes the default service conditions for the Services. It is a best-efforts commitment, not a guaranteed service credit regime. A signed business order form may state different or additional service levels.

26. Best-efforts service commitment

SafeSky will use commercially reasonable efforts to operate the Services. Continuous, uninterrupted, error-free or universally available operation is not guaranteed. No commitment is made regarding minimum coverage, number of detected participants, data accuracy, delivery latency or continued availability of a particular third-party source.

27. Maintenance and incidents

SafeSky may perform planned or emergency maintenance. Where practical, notice of material planned maintenance will be provided through a status page, Application notice, email or other appropriate channel. Emergency, security or third-party maintenance may occur without advance notice. SafeSky will use reasonable efforts to restore a materially disrupted Service.

28. Support

Support channels and hours are those published for the applicable plan. Unless a signed agreement says otherwise, response and resolution targets are objectives only and not guarantees. SafeSky may prioritise incidents by severity, impact, affected users, safety relevance and available information. Users must provide reasonably requested diagnostic information and cooperate in troubleshooting.

29. Exclusions and remedies

Service commitments do not apply to issues caused by: user devices, configuration, permissions or connectivity; third-party platforms or data sources; misuse or breach; beta or preview features; scheduled maintenance; cyberattack; legal or regulatory action; regional blocking; or events beyond SafeSky’s reasonable control.

Unless a signed agreement expressly provides service credits, SafeSky’s primary remedy for interruption or degradation is commercially reasonable restoration or correction. Refunds and statutory remedies remain available only where required by applicable law or the purchase channel’s mandatory rules.

30. Force majeure

Neither party is liable for delay or failure caused by events beyond reasonable control, including natural disaster, war, terrorism, civil unrest, epidemic, pandemic, labour dispute, power or telecommunications failure, internet or cloud outage, denial-of-service attack, governmental measure, sanctions, or failure of an essential third-party provider. The affected party will use reasonable efforts to mitigate the impact. If a paid business service is materially unavailable for more than sixty consecutive days due to force majeure, either party may terminate the affected order on written notice, without liability other than accrued payment obligations and mandatory refund rights.

SCHEDULE A. Apple App Store Terms

This Schedule applies when an Application is obtained through Apple’s App Store. If it conflicts with Part I only for Apple-mandated matters, this Schedule prevails.

SCHEDULE B. Google Play Terms and Disclosures

This Schedule applies when an Application is obtained through Google Play.

SCHEDULE C. Business and Integration Users

This Schedule applies to Business Users that display, redistribute, integrate or otherwise make SafeSky Data available to their own users under a written authorisation, plan or order form.

C.1 End-user disclosure
The Business User must clearly and prominently inform its end users, in its own terms, user interface or documentation, that:

C.2 Data protection roles
Each party will comply with applicable privacy law, maintain a lawful basis, process only necessary Personal Data, apply appropriate safeguards, support data-subject rights and notify the other party without undue delay of a relevant Personal Data breach. The parties will document controller/processor or equivalent roles and enter into a data processing agreement where required. International transfers must use a lawful transfer mechanism. These obligations survive while Personal Data obtained under the arrangement is processed.

C.3 Security and downstream use
The Business User must protect credentials and Data, prevent unauthorised access, and ensure that downstream recipients are bound by protections no less restrictive than the applicable agreement. No redistribution, sublicensing, resale or new purpose is permitted without SafeSky’s written authorisation.

C.4 Changes and deprecation
SafeSky may change or discontinue interfaces, formats, sources or Data. For a planned change expected to materially affect an authorised production integration, SafeSky will use reasonable efforts to provide at least sixty days’ advance notice, unless the change is urgent, security-related, legally required or controlled by a third party. The Business User is responsible for adapting its integration.

C.5 Indemnity
The Business User indemnity in section 11 applies, including to claims caused by failure to provide the required end-user disclosure or by presenting the Data as certified, complete, authoritative or fit for safety-critical use.

SCHEDULE D. Concise In-App Acceptance Notice

Important - non-certified situational-awareness information
SafeSky Sentinel and SafeSky Live provide non-certified, community and third-party information that may be incomplete, delayed, inaccurate or unavailable. They do not replace visual lookout, official aeronautical information, approved equipment, procedures or ATC instructions, and must not be used for air traffic control, separation, navigation, collision avoidance, IMC flight or any safety-critical decision. You remain solely responsible for safe and lawful operation.

By selecting “Accept”, you agree to the SafeSky Global Master Agreement and acknowledge the Privacy Policy. Any consent required for optional data processing will be requested separately.
